Conservation Restriction
Per M.G.L. Chapter 184 Section 31, A conservation restriction (CR) is a legal agreement that protects land by limiting what can be done with it. It can last forever or for a set number of years and is usually put in place by the landowner.
The goal is to keep the land mostly in its natural, scenic, open, or agricultural state. It may also allow for public recreational use.
This restriction can:
(1) Stop or limit construction of buildings, roads, signs, billboards, or utilities.
(2) Prevent dumping of trash, soil, or anything that harms the environment or makes the area look bad.
(3) Protect trees and plants from being cut down or destroyed.
(4) Restrict digging or removing soil, rocks, or minerals in ways that harm the land.
(5) Limit how the land is used, unless it’s for farming, forestry, or outdoor recreation.
(6) Protect natural systems like drainage, flood control, and soil and water conservation.
(7) Ban other activities that could damage the natural or scenic quality of the land.
In short, a conservation restriction helps ensure that land stays natural and healthy for the long term.
